A |     New Delhi, Oct 17 (UNI) The Gujarat government in its detailed affidavit filed before the Supreme Court in Bilkis Bano's 11 convicts remission case, said that third party strangers have no locus to challenge remission orders passed by competent authority strictly as per applicable law.

"It is pertinent to note that the petitioner, (Subhashini Ali) who is admittedly a political functionary, has not even pleaded that how she has the locus to seek for quashing the order of remission passed by the Respondent number 1 (Gujarat government) with respect to the 11 convicts sentenced by the Special Judge, Greater Mumbai," the Gujarat government in its detailed affidavit filed before the Supreme Court said.

Questioning the maintainability of the batch of pleas challenging the release of 11 convicts in Bilkis Bano case, Gujarat Govt has told the Top Court in its affidavit said that the petitioner (Subhashini Ali and others) has nowhere in the petition has pleaded as to how her fundamental rights have been abridged.

"The petitioner (Ali) also failed to establish as to how she is aggrieved by the action of the State Government. The mandatory pleadings of locus and infringement of fundamental rights is conspicuously missing from the petition," the affidavit copy of the Gujarat government, filed before the Supreme Court, said.

The Gujarat government has filed its affidavit after complying with the Supreme Court's order, which had heard the petitions by ⁦Subhashini Ali⁩ and others challenging the remission of the 11 convicts in the Bilkis Bano case.

The Supreme Court will tomorrow hear the petitions filed by CPI (M) Memnber of Parliament (MP) - Subhashini Ali, journalist Revati Laul and Prof Roop Rekha Verma challenging the Gujarat Government’s decision to grant remission to 11 convicts for killing 14 persons and sexually assaulting pregnant Bilkis Bano during the 2002 post-Godhra riots.

The Gujarat government had on August 10, 2022, in its order granted remission to 11 convicted rapists and child murderers from jail, which created a hue and cry in the society.

"It is the bonafide belief of the state government that the present petition is nothing but an abuse of PIL (Public Interest Litigation) jurisdiction of this court. Thereby this Court should dismiss all the related pleas challenging the remission granted to 11 convicts in Bilkis Bano case.

The State Government has considered the cases of all 11 Prisoners as per the policy of 1992 and remission was granted on August 10, 2022, it said.

The State Government considered all the opinions and decided to release 11 prisoners since they have completed 14 years and above in prisons and their behaviour was found to be good. After approval of the State Government, orders have been issued on August 10, to release the prisoners. Hence, in instance case the state has considered the proposals under policy of 1992 as directed by this Court and not granted under the circular governing grant of remission to prisoners as part of celebration of "Azad Amrit Mahotsav," the Gujarat government said, in its affidavit.

UNI XC SHK2300。    張 1주년 회견, 외연확장보다 '강성' 일변도 평가…중진들 "이대로 총선 승리 어렵다"국민의힘 장동혁 대표의 '당원주권 강화' 구상을 두고 당내 비판이 잇따르고 있다. 장 대표는 26일 취임 1주년을 맞아 사실상 강성 당원을 결집하고 이들의 영향력을 키우는 내용을 '개혁안'으로 발표했는데, 이는 곧 강성 지지층에 소구하는 장 대표의 당권 장악력을 높이겠다는 의도로 풀이된다. 6.3 지방선거 이후 거취 압박을 일축한 채 의원들과 접촉을 피해 온 장 대표가 충분한 내부 소통 없이 임기 완수 의지를 내보인 점도 문제로 꼽힌다. 국민의힘 소장파 의원 모임 '대안과미래' 간사 이성권 의원은 페이스북을 통해 "이재명 정권의 실정에도 대안 정당으로 자리매김하지 못했고, 6.3 지방선거에서도 낙제점을 받은 지난 1년의 성적에 대해 장 대표의 자평은 너무 관대하다"며 장 대표의 취임 1주년 기자회견에 대한 날 선 평가를 내놓았다. 이 의원은 "상식과 동떨어진 강성 지지층에 기댄 채 당의 합리적 노선 변화를 이루지 못한 장 대표가 점점 더 멀어져 가는 민심 앞에서 어떻게 '나 홀로 강한 정당'을 만들겠다는 것인지 전혀 공감할 수 없다"며 "지난 1년의 실패에 대한 책임을 지고 물러나는 것이 민심에 부응하는 유일한 길이자 국민의힘 혁신의 출발점"이라고 강조했다. 이 의원은 장 대표의 "용퇴"를 촉구했다. 재선 조은희 의원은 장 대표의 기자회견이 "자리 지키기"로 비친다며 "지금 국민의힘에 필요한 것은 말의 성찬이 아니라 당원과 국민의 선택을 다시 받는 전당대회다. 국민의 신뢰를 회복할 새로운 리더십부터 세워야 한다"고 요구했다. 5선 중진 김기현 의원은 장 대표의 구상이 당 외연 확장과 총선 승리에 도움 되지 않는다고 짚었다. 김 의원은 페이스북에서 "당이 거의 파산될 위기에 놓였을 때도 끝까지 당을 지탱해 준 당원의 지상명령인 내후년 총선 과반 당선을 위해, 당은 축소 지향적으로 성을 쌓을 것이 아니라 다양성·포용성을 바탕으로 한 '대통합의 모델'로서 길을 열어야 한다"고 말했다. 국민의힘 일부 중진 의원은 이날 오후 국회에서 비공개 회동을 갖고 "이런 상태에서 총선을 승리하기는 어렵다"고 의견을 모았다. 4선 이상 중진 의원 19명 중 주호영(6선), 김기현·나경원·조배숙(5선), 김상훈·박대출·유의동·윤재옥·이종배(4선) 의원 9명이 회동에 참석했다. 이들은 장 대표에게 정례 간담회를 요청하기로 했다. 다수 참석자는 "최근 의원들 징계 문제는 당의 화합과 결속을 해칠 우려가 있다. 심사숙고하는 게 좋겠다"는 의견도 냈다고 한다. 한 중진 의원은 <프레시안>과의 통화에서 "당 개혁은 당내 더 넓은 단위에서 의견을 수렴해야 나중에 결과가 있을 때 수용성이 더 크지 않을까"라며 "(장 대표가) 당의 어떤 단위와 이야기를 했는지 의원들 대부분은 모른다. 그래서 걱정"이라고 밝혔다. 한 영남권 의원은 "당 대표 혼자 안을 만들어서 일방적인 기자회견을 했을 때 그에 대해 이견을 제시하기 시작하면 또 갈등으로 비춰진다"며 "과정과 방향성 모두 문제"라고 지적했다. 장 대표 1주년 기자회견 관련 내용은 의원들은 물론 당 지도부에도 사전에 설명되거나, 공유되지 않았다고 한다. 장 대표는 '당협위원장 물갈이'와 관련해 반대 의견이 쏟아진 최근 의원총회에 연달아 불참하는 등 의원들과의 소통에 소극적인 태도를 보여왔다. 한 초선 의원은 "지방선거 평가부터 해야 한다"고 꼬집었다. 무소속 한동훈 의원은 국회에서 기자들과 만나 "그동안 당의 모든 방식이 사당화로 귀결된다"며 "국민 혈세를 받는 공당이 사당화되면 결코 제 역할을 할 수 없다"고 비판했다. 앞서 장 대표는 이날 오전 서울 여의도 중앙당사에서 취임 1주년 맞이 기자회견을 열고 "100만 책임당원의 손을 굳게 잡고 안으로부터의 개혁을 완수하고, 완전한 변화로 나아가겠다"며 "'당원주권 2.0' 시대를 열겠다"고 밝혔다. 임기 전환점을 맞은 장 대표는 당원 참여로 전국 당협위원장을 교체하는 등 향후 당 운영 구상을 기자회견문에 적시했는데, "'국민의힘 2.0'은 지금까지의 개혁과는 다를 것"이라고 자신감을 내비쳤다. 장 대표는 특히 "올림픽공원을 지키고 계신 청년들과 시민들"에게 감사를 전했다.                    ▲국민의힘 장동혁 대표가 26일 서울 여의도 중앙당사에서 열린 당 대표 취임 1주년 기자회견에 입장하고 있다. ⓒ연합뉴스。
